Declaration of free export

The Free Export Declaration is a template that includes all the main statements that customs may require for a specific item (Dual Use, Washington Declaration, etc.).

The Free Export Declaration must be reproduced in 2 copies and must be attached to the Commercial or Proforma Invoice.

Filling Out the Free Export Declaration

Filling out the Free Export Declaration is very simple because the template is already prepared, and you only need to add the following information:

  • Name and surname
  • Title (Shipping Manager, Owner, etc.)
  • Invoice number and date (in the case of a Commercial Invoice)
  • Package Tracking Number
  • Original stamp and signature

The Free Export Declaration must be reproduced on letterhead.

Declarations

The Free Export Declaration includes all statements certifying that the goods:

  • Do not fall under those protected by the Washington Convention, as per Council Regulation (EC) No. 338/97 of December 9, 1996, and subsequent amendments regarding the protection of species of wild flora and fauna.
  • Do not fall under the list of goods as per Council Regulation (EC) No. 116/2009 of December 18, 2008, regarding the export of cultural goods.
  • Do not fall under the list of goods as per Council Regulation (EC) No. 428/2009 of May 5, 2009, and subsequent amendments establishing a Community regime for the control of exports, transfers, brokering, and transit of dual-use products and are therefore intended for civil use.
  • Do not fall under the list of goods as per Council Regulation (EC) No. 1236/2005 of June 27, 2005, regarding the trade of certain goods that could be used for the death penalty, torture, or other cruel, inhuman, or degrading treatment or punishment.
  • Do not contain dog and cat fur in accordance with Regulation (EC) No. 1523/2007 of the European Parliament and of the Council of December 11, 2007.
  • Are not subject to the provisions of Regulation (EC) No. 689/2008 of the European Parliament and of the Council of June 17, 2008, on the export and import of hazardous chemicals.
  • Are not subject to the presentation of an export license as per Regulation (EC) No. 1005/2009 of the European Parliament and of the Council of September 16, 2009, on substances that deplete the ozone layer.
  • Do not fall under the list of goods as per Council Regulation (EC) No. 174/2005 of January 31, 2005, and subsequent amendments imposing restrictions on the provision of relevant assistance to military activities in Côte d'Ivoire.
  • Do not fall under the list of goods as per Council Regulation (EC) No. 314/2004 of February 19, 2004, and subsequent amendments regarding certain restrictive measures against Zimbabwe.
  • Do not fall under the list of goods as per Council Regulation (EC) No. 1210/2003 of July 7, 2003, regarding certain specific restrictions on economic and financial relations with Iraq.
  • Do not fall under the list of goods as per Council Regulation (EU) No. 204/2011 of March 2, 2011, concerning restrictive measures in light of the situation in Libya.
  • Do not fall under the list of goods as per Council Regulation (EU) No. 1284/2009 of December 22, 2009, establishing certain specific restrictive measures against the Republic of Guinea.
  • Do not fall under the list of goods as per Council Regulation (EC) No. 765/2006 of May 18, 2006, and subsequent amendments regarding restrictive measures against certain officials of Belarus.
  • Do not fall under the list of goods as per Council Regulation (EU) No. 36/2012 of January 18, 2012, and subsequent amendments concerning restrictive measures in light of the situation in Syria.

Mandate for Issuance of EUR 1 Certificate

The Free Export Declaration also includes the mandate for the express courier for the issuance of the EUR 1 document if the invoice contains the Preferential Origin Declaration and the value exceeds the limits for the validity of the substitute declaration.

  • Hereby, we also grant a mandate to UPS Italia srl to request from the competent Customs, if provided for by the current customs agreements, the issuance of the EUR 1 (or EUR-MED) / A.TR. certificate and to sign it on our behalf. It is declared that the goods referred to in this invoice are produced in Italy and/or in the Community and meet the rules of preferential origin. We also commit to providing, at any time, all necessary information for the issuance of the requested certificate.
